Elder Care Law

An elder law attorney assists clients with planning for future long-term care, estate planning, tax planning, asset protection planning, congregate care issues, homecare issues, right to die issues, guardianship issues, and planning for individuals with disabilities.

Many societal factors have contributed to the development of the elder care lawyer as a defined area of law. Two-income families have become the norm and families often move around the country as job opportunities dictate. There are a growing number of elderly individuals living longer, often in need of long-term care, which their children can no longer provide. The government responded by creating the Medicare program (to provide health insurance for individuals 65 years and over) and the Medicaid program (to provide health insurance for the poor elderly or disabled, including long-term custodial care). The complexity of Medicaid's resource and income eligibility rules has given rise to the new elder law practice area.
