Living Wills & Health Care Proxies
A Health Care Proxy is a power of attorney that governs health care decisions only, not financial decisions. Financial decisions are generally addressed by a durable power of attorney or trust agreement. A health care proxy sometimes called an advance directive, allows you to appoint an individual to make health care decisions in the event that you are incapable of making such decisions for yourself.
Once a health care proxy is drafted, you are able to make health care decisions as long as you are still competent to do so. The health care proxy should authorize your physician or other health care provider to share confidential medical information with your health care agent, if this is what you wish.
In addition to a health care proxy a living will should be utilized. A living will is a written statement of your wishes for continued life support and treatment in the event there is no medical expectation of recovery. The expression you make in your living will (which is often part of your health care proxy) will guide your health care agent in making decisions on your behalf.
