Our attorneys are well-versed in the Medicaid application process, which is often seen as the pre-administration of a person’s estate. We assist clients and their families with creating a proper elder law plan, which typically results in the elimination of a probate proceeding. Periodically, clients pass away before a plan can be completed or a previously undiscovered asset becomes known, in which case a small estate or probate is required. Additionally, all effective elder law planning must contemplate the prospect that the healthy spouse may predecease the spouse residing in the nursing home, giving rise to estate administration, right of election and Medicaid recovery issues.

Our services include:
  • Determining whether and to what extent a client’s wishes can be accomplished without having to probate a client’s will
  • Gathering all necessary documents, including: Last Will & Testament, trust agreements and financial documents
  • Reviewing beneficiary designations on IRAs, 401(k)s, life insurance or other testamentary substitutes
  • Determining which type of Estate Administration is appropriate or whether testamentary substitutes can be employed to avoid probate and safe guard the client’s testamentary plan
  • Preparing testate Administration or Probate, Intestate Administration, Small Estates Administration, Revocable Trust Administration or a combination
  • Determining elective share amounts when necessary
  • Planning to minimize Medicaid recovery against the Medicaid recipient’s or spouse’s estate
