In Home Care & Community Based Medicaid

Many clients who require long-term care prefer to receive homecare so that they can remain in their own home. Our elder law attorneys work with clients, family members and geriatric care managers or other medical professionals to put in place a safe and appropriate homecare plan. We implement asset protection strategies that allow clients to qualify for community Medicaid or waivered Medicaid programs to provide their homecare.

Our services include:
  • Understanding the ever-changing eligibility requirements of various community-based Medicaid or waivered Medicaid programs
  • Reviewing client asset and income information
  • Developing an asset protection strategy to allow clients to qualify for Medicaid’s maximum income and asset levels
  • Using and implementing proper timing of transfers, spousal refusal, income sheltering special needs trusts or community pooled special needs trusts
  • Preparation and filing of the Medicaid application, and appearance at the Medicaid interview
  • Reviewing financial documentation required for the Medicaid application
  • Coordinating and timing of the required Medicaid disability application
  • Preparing the application for pooled special needs trust (when applicable)
  • Submitting documentation to DSS of established and operating pooled or self-settled special needs trusts
  • Understanding and planning for a possible increase in care needs and nursing home care, and assisting clients to meet more stringent Chronic Care Medicaid eligibility requirements while continuing to protect assets and avoid penalty periods or unpaid nursing home bills
  • Assisting clients with the yearly community Medicaid recertification process
