Elder Law & Medicaid Planning

Kelly Gusmano counsels seniors and their families on developing and implementing appropriate care plans for those who may require long term care, whether that be home care or care for those residing in an independent living facility, assisted living, or skilled nursing home.  Kelly works to protect assets and assures that Medicaid applications are properly executed.  A variety of strategies are utilized in this process to cater to each client’s specific circumstance, including outright gifts, irrevocable Medicaid trusts, annuities, loans, supplemental needs trusts, and transfers of real property.

Kelly assists clients with Article 17-A and Article 81 guardianships to help care for those with personal or property management needs.  In addition, she helps guide clients through the process of transferring adult guardianships from one state to another, a process very new to the State of New York

Estate Planning

Kelly provides clients with necessary estate planning documents including wills, trusts, powers of attorney, and health care proxies.  She also assists clients with planning to avoid estate tax.
